Invest In The Growing U.S. Economy With An EB-5 Visa

The United States offers a pathway for foreign investors to contribute to the U.S. economy through the EB-5 Immigrant Investor Program. This program allows eligible individuals to invest in a new commercial enterprise and, in doing so, potentially qualify for lawful permanent residence (a green card).

At Caballero & Fernandez de Avila, P.A., we assist clients with the legal and procedural steps required for an EB-5 petition—from documenting the lawful source of funds to ensuring the investment meets job creation and regional center requirements. The process can be complex, but with the right legal guidance, it becomes far more manageable.

Whether you are investing directly or through a USCIS-approved regional center, we help ensure your petition is complete, compliant, and filed correctly.

What Are the Requirements for an EB-5 Visa?

To qualify for an EB-5 investor visa, your business must create at least ten full-time jobs for U.S. workers and involve a minimum investment of $1.8 million. However, if the investment is made in a Targeted Employment Area (TEA)—such as a rural region or an area with high unemployment—the minimum investment is reduced to $900,000.

These requirements are strictly enforced, and additional criteria may apply depending on how and where the investment is made. That’s why it’s important to work with an immigration law firm that understands the EB-5 process and can help ensure that your application is accurate, complete, and well-supported.

At Caballero & Fernandez de Avila, P.A., we assist investors in evaluating their eligibility, preparing the necessary documentation, and navigating the path to lawful permanent residency through investment. If you’re considering launching or investing in a U.S.-based business, we’re here to help guide you through each step of the EB-5 visa process.

What Else Do I Need to Know About the E-5 Visa Application Process?

As you plan your investment and business operations in the United States, you may find it necessary to bring in additional employees for roles that require specific qualifications—particularly when no suitable U.S. workers or green card holders are available. In these situations, we assist employers in exploring non-immigrant visa options, such as the H-1B and other employment-based programs, to help staff key positions legally and efficiently.

Because the EB-5 petition process can take six months or longer, it’s important to begin as early as possible. At Caballero & Fernandez de Avila, P.A., we help clients align their immigration planning with their business timelines so they can move forward without unnecessary delays.

If you’re preparing to launch a business and need immigration support, we’re here to assist at every stage.
