T-Visas for Victims of Human Trafficking
The T-visa is available to noncitizens who have been victims of severe forms of human trafficking, including labor and sex trafficking. This visa allows survivors to remain in the United States for up to four years, with the possibility of applying for lawful permanent residency later.
To qualify for a T-visa, applicants must:
- Be a victim of human trafficking
- Be physically present in the U.S. on account of trafficking
- Cooperate with law enforcement in the investigation or prosecution of the traffickers (with some exceptions for minors or those unable to cooperate due to trauma)
- Show they would suffer extreme hardship if removed from the U.S.

TPS (Temporary Protected Status)

- Can apply for work authorization
- Are protected from removal during the TPS period
Eligibility depends on nationality (or last habitual residence), continuous physical presence in the U.S. since a specific date, and registration within USCIS deadlines.
