Understanding the K-1 Fiancé Visa Process

The K-1 visa allows a U.S. citizen to bring their foreign fiancé(e) to the United States for the purpose of getting married. After the visa is issued, the couple must marry within 90 days of the fiancé(e)’s arrival. Once married, the foreign spouse can apply to adjust their status to become a lawful permanent resident (green card holder).

To qualify for a K-1 visa, you must:

  • Be a U.S. citizen
  • Intend to marry within 90 days of your fiancé(e)'s entry into the U.S.
  • Have met your fiancé(e) in person within the last two years (with some exceptions)
  • Demonstrate a valid, bona fide relationship

Our attorneys assist with:

  • Preparing and filing Form I-129F (Petition for Alien Fiancé(e))
  • Gathering supporting documentation and proof of relationship
  • Communicating with USCIS and the U.S. Embassy or Consulate abroad
  • Preparing for the visa interview
